NEW PLANNING ACT

The Planning system in Scotland underwent a radical change in 2009, and affected how technical advisors carry out their work. More than ever, we need to consider, from the very start of the project, how and when we present information. Are we dealing with a major or minor development? Is there a need for pre-application notice and consultation? Who will make the decision on the application? Who would consider any appeal?

Different skills will also be required through any appeal process, either through Inquiry or Hearing, or through the new Local Review Board process for local developments.

In the event of an appeal, the quality of the application submission, and of the planning authority’s responses to that submission, will take on an increased significance, since little, if any, additional information will be permitted from either side, before the appeal is considered and determined.

If you are a developer or landowner, make sure that your techical advisors are completely up to date with this latest legislation. Don't be caught out by new procedures!
